("Company," "we," "us," or "our") governing your use of the RESTO Platform, which includes
RESTO AI Designer, RESTO X Designer, RESTO Express, and all related applications, APIs,
websites, and services (collectively, the "Service").
By accessing or using the Service, you agree to be bound by these Terms. If you do not
agree to these Terms, do not use the Service.
Definitions
For purposes of these Terms:
- "Account" means your RESTO account.
- "Content" means any text, images, video, audio, or other materials uploaded, generated, or
displayed on the Service.
- "Customer" means the person or entity that has entered into these Terms.
- "Service" means the RESTO Platform, including RESTO AI Designer, RESTO X Designer, RESTO
Express, and all related applications, APIs, and websites.
- "User" means an individual authorized by the Customer to use the Service.
- "User Submissions" means Content provided or made available by Users through the Service.
- "White Label" means our optional add-on service allowing resale of the Service under the
Customer's brand.
General Terms
1. Accepting These Terms
By signing up for or using the Service, you agree to follow these Terms. If you are using
the Service on behalf of an organization, you represent that you have authority to bind that
organization.
2. Your Account
- Responsibility: You are responsible for all activity under your Account.
- Security: RESTO uses magic-link authentication; keep your email secure. Notify us of
unauthorized access.
- Accuracy: Provide and maintain accurate account information.
- Age Requirement: You must be at least 18 years old or have parental consent.
3. How We Provide the Service
- The Service is provided "as is."
- Support is offered via email only unless otherwise stated.
- We use third-party providers for hosting, storage, and infrastructure.
- We strive for high availability but cannot guarantee uninterrupted uptime.

5. Prohibited Uses
You may not:

Violations may result in immediate suspension or termination.
6. White Label Exception
If you have the White Label add-on, you may:
- Resell the Service under your own brand
- Set your own pricing and terms
- Manage customer billing directly

7. File Storage Limits

- 500GB storage per customer account
- Unlimited users (within your plan limits)
- Automatic compression for efficiency

8. Fair Use Policy
- Files unused for 30+ days may move to slower archival storage
- Accounts in the top 5% of usage may require a custom plan
- We will contact you before changes apply
9. Account Inactivity
- No login for 3 months = inactive
- You'll receive a 60-day warning before file deletion
- Logging in reactivates your account

You grant RESTO a non-exclusive, worldwide, royalty-free, transferable license to use your
Content solely for operating, supporting, and improving the Service.
You represent that:
- You own or have rights to your Content
- Your Content doesn't violate third-party rights
- You have consent from individuals appearing in content
17. Company Property
The Service (software, design, documentation) belongs exclusively to RESTO Co. and its
licensors.
You may not use RESTO's trademarks without permission.
18. Feedback
Any feedback may be used by RESTO without obligation.

We offer integrations with third-party services.
Each service has its own terms.
RESTO is not responsible for third-party performance or data handling.
20. Data Processors We Use
Limited data is shared with:
- Infrastructure: AWS, Render, Cloudflare, Backblaze
- Payments: Stripe, Paddle
- Analytics: Google Analytics
- Communications: Email providers
- AI Services: OpenAI, Anthropic
- Mobile Platforms: Apple, Google Play
- Integrations: Make.com, Zapier, Albato, Pabbly, etc.
API Usage
21. API Access
- Available on paid plans
- 1000 requests/hour limit

- May not be used to bypass plan limits
22. API Restrictions
You may not:
- Scrape or export bulk data
- Share API keys
- Violate rate limits
- Abuse or overload servers
RESTO may suspend access for abuse.

27. Limitation of Liability
RESTO is not liable for:
- Lost profits
- Data loss
- Indirect or consequential damages
- Damages exceeding what you paid in last 3 months
28. No Warranties
The Service is provided "as is."
We do not guarantee:
- Error-free operation
- Uninterrupted access
- Specific performance outcomes
Indemnification
29. Your Obligations
You agree to indemnify RESTO against claims arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of third-party rights
- Your Content
Dispute Resolution
30. Informal Resolution
You agree to attempt resolution via [email protected] before filing any claim.
After 60 days unresolved, either party may proceed formally.
31. Binding Arbitration
Disputes are settled by binding arbitration under AAA rules in Wilmington, Delaware.
32. Class Action Waiver
All disputes must be individual.
No class actions or representative actions allowed.
33. Governing Law
Delaware state law governs these Terms.
Export Compliance

You agree to comply with all U.S. export and sanctions laws applicable to the Service.

40. Community Conduct
Be respectful and constructive. No harassment, hate speech, spam, impersonation, or
malicious content.
Moderation:
- Comments may be reviewed
- Attempting to bypass moderation may result in account suspension or banning
